Welcome to BCX Orchids. By accessing our website and purchasing our products, you agree to be bound by the following terms and conditions. Please read them carefully before completing a purchase.

1. General Conditions

We reserve the right to refuse service to anyone for any reason at any time. By placing an order, you represent that you are at least the age of majority in your state or province of residence.

2. Accuracy of Information

While we strive for perfection, plants are living organisms.

Variations: You acknowledge that plants vary in size, shape, and bloom stage. Photos on our website are representative of the species but not necessarily the exact plant you will receive.
Pricing: We reserve the right to modify prices or discontinue products without notice.

3. Payment & Cancellations

Payment: All orders must be paid in full at the time of purchase.
Cancellations: You may request a cancellation within 12 hours of order placement. Approved cancellations are subject to a 5% processing fee to cover non-refundable transaction costs. Once an order is processed or shipped, it cannot be cancelled.

4. Shipping & Delivery Risks

Your agreement to these terms includes acknowledgment of our Shipping Policy:

Transfer of Risk: All items purchased are made pursuant to a shipment contract. This means that the risk of loss and title for such items pass to you upon our delivery to the carrier.
Weather Responsibility: It is the customer's responsibility to monitor local weather and purchase necessary protection (heat/cold packs).
Address Accuracy: We are not liable for packages delivered to incorrect addresses provided by the customer or packages left unattended after delivery.

5. Live Arrival & Returns

All Sales Final: Due to the perishable nature of orchids, all sales are final. We do not accept returns or exchanges.
Limited Guarantee: We offer a 24-hour Live Arrival Guarantee. To claim store credit or a replacement (if available), you must provide photo evidence of the plant and packaging within 24 hours of the delivery timestamp.
Exclusions: Our guarantee does not cover issues reported after 24 hours, carrier delays, or damage resulting from improper care after arrival.

6. Combined Orders & Additional Fees

We reserve the right to combine multiple orders to the same address. If a combined shipment exceeds standard weight or size limits, or if a delivery address is in a remote/rural area, we reserve the right to invoice you for additional shipping fees prior to dispatch.

7. Prohibited Uses

You are prohibited from using our site or its content: (a) for any unlawful purpose; (b) to solicit others to perform or participate in any unlawful acts; (c) to violate any international, federal, or provincial regulations.

8. Limitation of Liability

In no case shall BCX Orchids, our directors, or employees be liable for any injury, loss, claim, or any direct, indirect, incidental, or consequential damages of any kind, including, without limitation, lost profits or replacement costs, arising from your use of any of our products.

9. Changes to Terms of Service

We reserve the right to update, change, or replace any part of these Terms of Service by posting updates to our website. It is your responsibility to check this page periodically for changes.
